Italian citizenship explained
Jure Sanguinis: Italian citizenship by right of blood.
If you’ve ever looked into Italian citizenship through ancestry, you’ve probably seen the term jure sanguinis and immediately thought, “This is about to get complicated.”
Let’s strip it down to the essentials. No legal jargon, no footnotes.
Here’s Jure Sanguinis 101, explained plainly along with the chronological order of the process.
What “Jure Sanguinis” Actually Means
It translates to “by right of blood.” Italy allows citizenship to be passed down from an Italian ancestor to their descendants, even generations later, as long as certain conditions are met.
What Jure Sanguinis Is Not
It’s not an immigration program
It’s not discretionary
It’s not something Italy “grants” as a favor
If you qualify, it’s a legal recognition of an existing right.
Step 1: Having Your Eligibility Determined
Just because we come from Italian blood does not mean one is automatically eligible for Italian citizenship. Even if our parents are the one’s from Italy. Yes, you could be first generation and not eligible for Italian citizenship.
Determining eligibility involves the consideration of many different laws and details. Especially now that the eligibility requirements have changed.
However, once eligiblity has been positively determined, you may then begin assessing how you’d like to acquire citizenship. Which brings us to the second step.
Step 2: Consulate, Residency or Court System?
There are three ways of acquiring Italian citizenship through your bloodline: The consulate, by moving to Italy and establishing residency, or through the court system. Let’s break down each one.
Consulate: This option is the one that the majority of people choose, but only because it’s the most well-known. Going through the consulate is considered the most economical choice as it’s considered the public service provided by the Italian government. However, like most public services..…it doesn’t work.
With the government lockdowns taking effect in 2020, all Italian consulates in the world halted operations for about 2 years. Once they reopened, they found themselves with 6,000+ people on their waitlists. This is why we’re all experiencing the same backlog regardless of where we’re living.
Timeline expectation: 5-6 years (for now). Italian consulates plan to officially halt all citizenship operations by January 2028. The years leading up to 2028 will be met with harshly limited citizenship appointment availability.
Note: this option is not available for minor cases, 1948 cases or generational cap trials.
Moving to Italy: This is the fastest way of acquiring Italian citizenship. However, you’d have to establish residency first.
No, you cannot apply for Italian citizenship in Italy while passing through on your 2-weeks vacation. In order to be able to apply in Italy, you’d have to establish residency (the town will send a marshal to your home to verify you’re actually living there) and then you’ll be able to apply for citizenship.
This is a good option for those who are looking for adventure and don’t have too many ties to their home country.
Timeline expectation: 3-6 months uninterrupted.
Note: this option is not available for minor cases, 1948 cases or generational cap trials,
Court System: The happy medium and what we specialize in here at Italy360Pro. This option is for those who don’t want deal with the headache of going through their consulate, but also don’t have the ability to move to Italy for a few months. The process takes place in the courts of jurisdiction in which your eligible ancestor was born.
Going through the court system is an option for every kind of case and it’s what we specialize in.
Timeline expectation: 8-24 months.
Step 3: Collect and Prepare Your Documents
Once you have confirmation on which ancestor you’re eligible through and you have the clarity as to how you’ll pursue citizenship, then, and only then, may you begin collecting and preparing your citizenship folder.
Generally speaking the documents needed for collection include birth, marriage, divorce and death certificates wherever they may apply connecting you to your ancestor.
Once your documents have been ordered new, they will then need to go through a preparation process: apostilling, then translations and legalizations in that order.
